I have some "problem" with my Gti-r...

In winter time when its slippery the car feels like an rwd. But
when the car gets warmed it goes almoust like an 4wd...

Now when the roads are getting more dry i still dont get that
4wd traction and some of the wheels will lost traction.

Is this transfer box oil issue or is this transfer box dead?

I'm not an expert, but it sounds to me like a fault with the viscous coupling... although I've got no idea what's happening or why.

I would have thought if it was not engaging you'd only have FWD, and if it had locked solid there's always be 4WD. - To not have any power to the front axle when it's cold is really odd since that's attached to the gearbox.

Could it be a suspension set-up issue? - Have you stiffened the rear axle so much that it oversteers from cocking a wheel in the wet by any chance. A less compliant axle gets less grip so is a good way to push the grip to the front axle and dial-out understeer. (Which also means if you make the front too stiff the car will be more prone to it.)
